INTERPRETATION AND DEFINITIONS

Interpretation

Words with capitalized first letters have meanings defined below. These definitions apply whether the terms appear in singular or plural.

Definitions

• Account means a registered profile created by You to access the Service.
• Application refers to the WingMann mobile application and related platform.
• Company refers to WingMann, operating in India.
• Content means text, photos, videos, audio, messages, profile information, or any other material posted, shared, or transmitted through the Service.
• User or You means any individual who accesses or uses the Service.
• Community Guidelines refers to the rules governing acceptable behavior on the platform.

1. ELIGIBILITY

To use WingMann:

• You must be at least 18 years old.
• You must have the legal capacity to enter into a binding agreement.
• You must not be prohibited from using the Service under applicable laws.
• You must not have been previously banned from WingMann.

By using the Service, You represent and warrant that You meet these requirements.

2. ACCOUNT REGISTRATION

You agree to:

• Provide accurate and truthful information.
• Maintain the confidentiality of your login credentials.
• Be solely responsible for all activity under your account.

We reserve the right to suspend or terminate accounts that provide false or misleading information.

3. SERIOUS INTENT POLICY

WingMann is designed exclusively for individuals seeking meaningful and intentional relationships.

By using the Service, You agree that:

• You are not using the platform for casual hookups, solicitation, or entertainment purposes.
• You will not misrepresent your relationship intent.
• You will engage respectfully and authentically.

We reserve the right to remove users who violate the spirit of serious intent.

4. COMMUNITY CONDUCT

You agree NOT to:

• Harass, threaten, stalk, or intimidate other users.
• Share explicit, obscene, or sexually exploitative content.
• Impersonate another person.
• Use the Service for commercial solicitation.
• Share another user’s personal information without consent.
• Screenshot, record, or distribute private conversations without consent.
• Attempt to manipulate compatibility systems.

Violation may result in immediate suspension or permanent ban without prior notice.

5. CONTENT OWNERSHIP AND LICENSE

You retain ownership of Content you post.

However, by posting Content, You grant WingMann a worldwide, non-exclusive, royalty-free license to:

• Use
• Display
• Reproduce
• Modify (for formatting purposes)
• Distribute

Such use is solely for operating and promoting the Service.

You represent that you have the rights necessary to grant this license.

6. AI MODERATION AND ENFORCEMENT

WingMann may use:

• Automated systems
• Behavioral analytics
• Manual review teams

To monitor compliance with these Terms.

We reserve the right to:

• Remove content
• Restrict visibility
• Suspend accounts
• Permanently ban users

Decisions may be based on algorithmic detection combined with human oversight.

You acknowledge that enforcement decisions are final and at the Company’s discretion.

7. USER INTERACTIONS AND RISK DISCLAIMER

WingMann does not conduct full criminal background checks unless explicitly stated.

You acknowledge that:

• You are solely responsible for your interactions with other users.
• The Company is not liable for the conduct of any user.
• We do not guarantee compatibility, success of relationships, or user authenticity beyond reasonable safeguards.
• Offline meetings occur at your own risk.

8. PAYMENTS AND SUBSCRIPTIONS

If WingMann offers paid services:

• Fees will be clearly disclosed before purchase.
• Payments are non-refundable unless required by law.
• Subscription renewals may occur automatically unless canceled.
• Failure to pay may result in restricted access.

9. TERMINATION

We may suspend or terminate your account if:

• You violate these Terms.
• You violate Community Guidelines.
• You engage in harmful or deceptive behavior.
• We believe your presence poses risk to other users.

You may terminate your account at any time via account settings.

Termination does not eliminate obligations incurred prior to termination.

10. INTELLECTUAL PROPERTY

All trademarks, logos, branding, design elements, and platform algorithms belong to WingMann.

You may not:

• Copy platform design
• Reverse engineer algorithms
• Use branding without written permission

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

WingMann shall not be liable for:

• Emotional distress
• Relationship outcomes
• User misrepresentation
• Harassment by other users
• Indirect or consequential damages
• Loss of profits or opportunity

Our total liability shall not exceed the amount paid by You (if any) in the preceding 6 months.

12. INDEMNIFICATION

You agree to indemnify and hold WingMann harmless from any claims, damages, liabilities, or expenses arising from:

• Your misuse of the Service
• Your violation of these Terms
• Your interactions with other users
• Your violation of any third-party rights

13. PRIVACY

Your use of the Service is also governed by our Privacy Policy.

14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of courts located in Karnataka, India.

We may attempt informal resolution before formal proceedings.

15. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time.

We will notify users via:

• In-app notification
• Email
• Updated “Last Updated” date

Continued use of the Service after changes constitutes acceptance.
